Praise be to Allah SWT, the owner of the worlds. Peace and blessings for Prophet Muhammad SAW, his family members, his friends, muslimin and muslimat as well as Islamic fighters who always support and uphold the righteous religion of the Allah.

Waqf literal meaning had existed before the arrival of Islam. In fact, welfare-based practices and systems such as res sacrae, piae causae and fidei commissum have long been practiced among the Byzantine and Roman communities. Its practice and legal system are similar to the practice and legal system of waqf practiced among Muslims.

Hence, Western orientalists have claimed and accused that waqf was created through Western civilization. The question is, what exactly is the basic form of practice and the legal system of res sacrae, piae causae and fidei commissum? What about looking at the equation from its legal aspects and practices, waqf is said to have been the result of the influence of the past two kingdoms? Based on the above scenario, this book is written with the goal of achieving two purposes. First, identify the basis of the existence of such legal practices and systems. Secondly, analyzing the relationship between the legal system of res sacrae, piae causae and fidei commissum with waqf.

The findings of this book prove scientifically that the practice and legal system of waqf actually exist based on Islamic tasawwur based on al-Quran, al-Sunnah Rasulullah SAW and the ijma 'ulama. At the same time, refusing allegations of Western orientalists accusing and claiming that their practices and legal systems were created from Byzantine or Roman civilization.

The writing of this book is made in simple language style and is provided in a descriptive form to answer the allegations and indictments. Therefore, this book is suitable for early reading by Islamic and non-Muslim communities who are keen to recognize and understand the philosophy of waqf according to Islam. The authors of this book hope that this book will be able to educate and give real understanding to the community about the existence and importance of waqf. More importantly, this book is expected to help every Muslim to fulfill the obligation to waqf as an important source of funding for the ummah after being outdated from the mainstream management.
